Welcome to Heartly. These Terms and Conditions outline the rules and regulations for the use of the Heartly application, developed and operated by Nayandeep Verma, located in Madhya Pradesh, India.

By accessing this app, we assume you accept these terms and conditions. Do not continue to use Heartly if you do not agree to take all of the terms and conditions stated on this page.

1. Eligibility

You must be at least 18 years old to use Heartly. By creating an account and using the application, you represent and warrant that you are 18 years of age or older. We reserve the right to suspend or terminate accounts that we suspect belong to minors.

2. Acceptable Use & Conduct

You agree not to use the Heartly application to:

• Harass, abuse, threaten, or behave aggressively toward other users, callers, or certified listeners.
• Engage in or share sexually explicit, adult, violent, hateful, or illegal conversations or content.
• Spam, scam, solicit funds, or engage in deceptive financial practices.
• Impersonate any person or entity.
• Engage in artificial call-duration manipulation or "call farming" to generate fraudulent earnings.

Violation of these conduct rules will result in immediate, permanent account suspension, and forfeiture of any virtual balances or pending earnings.

3. Virtual Currency (Coins) & Purchases

Heartly offers virtual currency ("Coins"). You acknowledge that these virtual items have no real-world monetary value and cannot be exchanged for fiat currency outside the app. All purchases are handled through Google Play Store Billing and are final and non-refundable, as detailed in our Refund Policy.

4. Certified Listeners, Earnings & Withdrawals

If you are registered and approved as a "Certified Listener" on Heartly, the following terms apply to you:

• Earning Rate: Certified Listeners can set their own earning rates per minute (within limits defined by the platform, such as ₹5.0/min to ₹50.0/min).
• Platform Commission: The platform may charge a service fee or commission from your total earnings as defined dynamically in the application dashboard.
• Withdrawals: Listeners can request a payout of their accumulated earnings in Indian Rupees (₹). All withdrawal requests are reviewed by our administration team.
• Verification & KYC: To process withdrawals, you must provide valid bank details, UPI IDs, and any compliance/KYC documents (such as a PAN card for Indian tax regulations) as requested.
• Forfeiture of Earnings: We reserve the absolute right to freeze, deduct, or cancel withdrawal requests and suspend accounts if we detect suspicious activities, call-manipulation, fraudulent transactions, or violations of our Acceptable Use policies.

5. Governing Law

These terms and conditions are governed by and construed in accordance with the laws of Madhya Pradesh, India. You irrevocably submit to the exclusive jurisdiction of the courts in that State or location.
